A customer who buys a 30-day supply and runs out has to decide again whether to buy from you, from Amazon or not at all. Replenishment is where wellness brands make their margin, so we treat subscriptions as core architecture rather than an app bolted on after launch.
That means subscribe-and-save pricing that works with your promotions, a customer portal where people can skip, swap flavour or change frequency without emailing support, and billing retry logic that recovers failed cards before the subscription quietly lapses. Usually not. A store that sells vitamins, protein, skincare or other wellness products directly to consumers is rarely a HIPAA covered entity or business associate, and ordinary order data is not protected health information under HIPAA. It changes when the business adds telehealth consultations, prescriptions, lab testing or clinician-reviewed intake forms, because those involve covered entities. In that case we isolate the clinical features on HIPAA-eligible services under a business associate agreement. Separately, state laws such as Washington's My Health My Data Act can apply to consumer health data even without HIPAA, so we minimise what the store collects. Confirm your position with counsel.
We build the store so compliant claims are easy and non-compliant ones are hard to publish. Dietary supplements can make structure and function claims but not disease claims, and those claims need the FDA disclaimer, so we add structured product fields for the claim and disclaimer rather than leaving them in free text. The FTC expects claims and testimonials to be substantiated, so we add a review step to the content workflow and moderate customer reviews for disease claims. Yes. Some states restrict sales of certain products by age, for example some weight-loss and muscle-building supplements, and hemp and nicotine products have their own limits. We build age verification into checkout per product and per destination state, so it applies only where it is required and does not add friction to every order. Depending on the risk, verification can be a date-of-birth check, a third-party identity check, or age confirmation at delivery through the carrier. A one-time popup on the homepage is not verification, and processors and regulators do not treat it as such.
We keep the restriction rules as data in the store, product by product and state by state, and enforce them before payment. A customer in a state that restricts a product sees a clear message at cart, rather than paying and then getting a cancellation email. This matters most for hemp-derived and CBD products, alcohol-based tinctures and certain ingredients, where rules differ between states and change often. Because the rules are held in a table rather than written into code, your team can update them when a state changes its law, without a developer release. Carrier restrictions are handled the same way.
Mainstream processors such as Shopify Payments and Stripe restrict some wellness categories, including CBD, some weight-loss products and supplement trial offers, and can freeze an account after launch. For those products we integrate high-risk merchant accounts through gateways such as Authorize.net or NMI, connected to a processor that has approved your category. We also reduce the chargebacks that put accounts at risk: clear subscription terms, easy cancellation, recognisable billing descriptors and good order confirmation emails. On Magento you can switch processors without replatforming, which is one reason high-risk brands choose it over hosted checkouts.
Subscriptions should be part of the architecture from the start, because replenishment is where most wellness brands make their margin. A good setup includes subscribe-and-save pricing that works with your promotions, a self-serve portal to skip, pause, swap or change frequency, dunning and card updater services to recover failed payments, and reminders timed to when the supply runs out. US courts have repeatedly treated ecommerce sites as covered by the ADA, and accessibility claims against online stores are common, so it is sensible to build to a recognised standard. We use WCAG 2.2 AA as the build standard and test the pages that carry the sale: product pages, cart, checkout and the customer account area. That covers keyboard navigation, colour contrast, form labels and error messages, alt text and screen reader behaviour. Accessibility overlay widgets do not fix the underlying code and have not stopped claims, so we fix the markup itself. Accessibility also tends to improve conversion for all customers.
Most new supplement brands should start on Shopify. It is faster to launch, cheaper to run, and has a mature subscription ecosystem. No. Shopify does not sign a business associate agreement, and Shopify's Acceptable Use Policy lists uploading protected health information subject to HIPAA as something the platform does not support. For most supplement and wellness stores this does not matter, because ordinary order data is not protected health information. It matters when you add telehealth, prescriptions, lab tests or clinical intake forms. Then the clinical part has to run outside Shopify, on a HIPAA-eligible service under a business associate agreement, and Shopify only receives the order details it needs to ship. Confirm your own position with counsel.
